Privacy Policy of the company Eptimum

1. Who is responsible for processing?

Eptimum, a simplified joint stock company with capital of €510,003, whose registered office is located at 49 rue de la Vanne, 92120 Montrouge, is the publisher of the Eptimum.com online store, which offers a full range of professional and consumer software.

This Privacy Policy sets out the commitments of the company Eptimum regarding the protection of your personal data as a customer or internet user and user of its services. It sets out how your personal data is collected and used, and your rights in this regard.

The company Eptimum complies with the French Data Protection Act No. 78 of 6 January 1978, as amended, the French Law on Confidence and the Digital Economy No. 2004-575 of 21 June 2004, and Regulation 2016/679 of 27 April 2016.

The company Eptimum has appointed a Data Protection Officer (DPO) responsible for ensuring that the law is properly applied and that your rights of access, rectification, opposition, erasure, restriction and portability are respected in accordance with the aforementioned law (dpo@eptimum.com).

2. What personal data is collected on our websites and why?

As Data Controller within the meaning of the French Data Protection Act and Regulation 2016/679 of 27 April 2016, the company Eptimum is responsible for the personal data it collects.

The data is collected in order to enable you, as a customer, prospect or simple user of our services, to receive personalised information, manage your orders, receive tailored commercial offers and, where applicable, benefit from offers from our partners. This data also enables our services to administer and improve our marketing activities and services for our customers.

When your personal data is collected, you are informed of the mandatory nature of the information requested in order to benefit from a service, or its optional nature, as well as the consequences of not providing certain data. You are also informed of the use that Eptimum will make of your data, and of your right to access, rectify, object to, erase, and transfer your data, to restrict its processing, and to know what will happen to your data after your death.

Declarative data:

The company Eptimum collects the data necessary for the use of the service you have chosen or for the management of your order. The data collected on this occasion may include: your first and last name, your postal address, your email address, and your telephone number.

You may be offered commercial offers from the company Eptimum or its partners on this occasion. In accordance with the law on 'Confidence in the Digital Economy', you must clearly express your consent by ticking a box confirming your agreement, where applicable. You will of course have the option to withdraw your consent at any time by exercising your rights of opposition, erasure or restriction. However, you will not be able to question the lawfulness of the processing carried out prior to withdrawal.

All this data is stored in our customer database so that we can communicate with you and offer you services tailored to your needs.

Behavioural data:

you may be asked to respond to online surveys offered by Eptimum because you are a customer and user of products or services. These surveys are anonymous. However, we may ask for your consent to keep some declarative behavioural data associated with your customer account. In this case, with your consent, we will retain this data. You will then be informed of your rights of access, rectification, erasure and objection, and the means of exercising them.

We may also store events relating to interactions between you and the services of the company Eptimum (page loads, button clicks, click rates on newsletters, banners, etc.) in order to offer you offers tailored to your wishes and, in general, to improve our services in line with our customers' expectations. In this case, with your consent, we will retain this data. You will then be informed of your rights of access, rectification, opposition and erasure, data portability and restriction of processing, and of the means of exercising these rights.

3. How does Eptimum use your personal data?

Declarative data

Declarative data is necessary for the registration and management of your orders, or for the use of the services offered by the websites of the company Eptimum.

Data concerning your interests or the composition of your household may enable the company Eptimum to make suggestions tailored to your needs.

Your email address may be used under the following conditions:

  • If you are a customer of Eptimum, it may send you offers for products similar to those you have already ordered.
  • When your email address is collected, or at a later date, you may be asked to tick a box confirming your agreement to receive commercial offers from the company Eptimum. If you agree by ticking this box, the company Eptimum may send you offers for the products it sells by email.

The company Eptimum nevertheless informs you that exceptions exist. The law allows you to be called if:

  • You are our customer.
  • You have provided your telephone number in an unambiguous manner: we will then be able to contact you within three months of the date on which you provided your telephone number.

Behavioural data

When you visit the websites of the company Eptimum, cookies may be stored on your computer. The company Eptimum complies with the CNIL recommendation of 5 December 2013 concerning cookies:

4. Who are the recipients of your personal data?

The personal data collected is intended for the company Eptimum.

Your personal data will not be disclosed to third parties, except in the following cases:

  • When you have given your prior consent to the sharing and/or disclosure of your Personal Data, including through the features offered by the websites of the company Eptimum.
  • When the company Eptimum needs to share your Personal Data with business partners (as authorised by you), suppliers, service providers and, in particular, technical service providers for the purposes of providing services, resolving service malfunctions or offering advertising and promotional information in connection with the services offered by the company Eptimum.
  • The company Eptimum provides your Personal Data to third-party companies to provide services on its behalf, including payment processing, data analysis, direct mail campaign processing, subscription and re-subscription information flow management, service hosting, and processing of certain marketing aspects of the services.

The company Eptimum does not share your Personal Data with third-party advertisers for targeted marketing purposes unless you have given your prior consent. However, it should be noted that advertisers may obtain your Personal Data from other public sources. The company Eptimum cannot be held liable in this regard.

However, Eptimum may use and share with third parties certain technical or aggregated non-personal data relating to your browsing on Eptimum websites. The collection, processing and disclosure of such anonymised data shall not be subject to the restrictions set out herein.

5. How long do we keep your personal data?

The retention period for your Personal Data may vary depending on the purpose for which it was collected.

In order to provide its services, and in particular to manage information flows, Eptimum may transfer your Personal Data to subcontractors located outside the European Union for these purposes only. In order to ensure the protection of your privacy and your Personal Data, the subcontractors concerned are signatories to the standard contractual clauses approved by the European Commission.

7. What is our cookie management policy?

In accordance with Decree No. 2007-451 of 25 March 2007 implementing the Data Protection Act, your requests must be made in writing, signed and accompanied by a photocopy of an identity document bearing your signature. The request must specify the address to which the reply should be sent. The company Eptimum will have one (1) month to respond after receiving your request.

For your information, you have the right to refer the matter to the French Data Protection Authority (Commission nationale de l'Informatique et des Libertés), whose contact details can be found at https://www.cnil.fr/fr/vous-souhaitez-contacter-la-cnil) if the company Eptimum has not responded to your request within one month of your request.
